The working party recommended the substantial extension of the jurisdiction and role of the CFI in that most direct actions should begin there and most appeals on special areas of the law, such as intellectual property, should finish there. There would be a limited possibility for preliminary questions to be referred on specialist areas of law such as intellectual property. If implemented, the working party's report would mean that the Court was no longer a Court of First Instance.

The Court has itself recently proposed changes: the advisory board of the British Institute of International and Comparative Law has reviewed the whole problem and made a report, the Reflection Groupe has reported. The Commission has considered the report and indicated its views, some of them purely provisional, to the inter-governmental conference. In the past the architecture of the Community legal system and the problems to be resolved have not featured very large, if they have featured at all, on the agenda of the Member States at inter-governmental conferences.

This was the fourth item on the agenda. 5 In the meantime, in February 2000, enlargement negotiations had been formally launched with six more candidate States,6 so that negotiations were now being conducted with twelve States in parallel, while Turkey had been accorded the status of candidate. The need for institutional adjustments became even more pressing. Member States definitely had their backs to the wall. Such was the agenda of the IGC. Therefore, one has to judge its results according to thesefiveissues, and not to something else, such as shaping the "Europe of the future", despite the background given by Joshka Fisher's famous speech and the debate which followed.
